Terms & Conditions

These are the Terms and Conditions governing the sale and the after-sale services by King Fook Jewellery Group Limited (“King Fook”) in the Hong Kong Special Administrative Region (“Hong Kong”).

 

Merchandises and order 

1.     Due to production requirements, the parts of King Fook chuk kam (足金) and chuk pak kam (足鉑/白金) products such as hinges, clasps, pins, springs and screws are respectively made of not less than 900 gold and 900 platinum.   
2.     In buying-back its chuk kam (足金) products and chuk pak kam (足鉑/白金) products, King Fook will act in accordance with our rules  at the material time.    
3.     Clocks and watches, mobile phones, lighters, writing instruments and gifts etc. sold by King Fook are sold under warranty of their manufacturers.  During the warranty period, maintenance and repair will be conducted subject to the respective terms of these Terms and Conditions and those of the manufacturers’ warranty.   

4.     Orders of products placed with King Fook shall be considered abandoned if client fails to pay the balance of the price for and collect the products within 3 months from the date of issue of the relevant sales invoice or order form. In such event King Fook shall be entitled to forfeit all deposits and monies paid and abandoned by client and King Fook’s obligations whatsoever in respect of the products shall be absolutely discharged.   

 
 Exchange policy   
 
 5.     Save and except as provided under the relevant legislation under the Laws of Hong Kong, King Fook may at its absolute discretion decline requests for return or exchange of any products whatsoever without providing any reason for such decision.   
 6.     Notwithstanding Clause 5, all natural jades, gemstone jewellery, pearl jewellery, branded jewellery (except Solasfera products), diamond jewellery modeled after antiques, ornaments with colour diamonds, special priced diamond ornaments and custom-made diamond jewellery shall not be returned or exchanged and the Client is deemed to have inspected such products and fully accepts their condition as they are upon purchase. And other diamond jewellery may only be exchanged once as follows:   
    (i)     within 14 days immediately following the date of the sales invoice, client may exchange the returned jewellery for jewellery of the same purchase price; or   
    (ii)     from 15 to 90 days immediately following the date of the sales invoice, client may exchange the returned jewellery for cash at 70% of the purchase price; or   
    (iii)     from 15 days to 1 year immediately following the date of the sales invoice, client may exchange the returned jewellery for new jewellery on the following basis:   
        a.     the returned jewellery will be valued at 90% of its purchase price if the purchase price of the new jewellery is less than or equal to 130% of the purchase price of the returned jewellery; or   
        b.     the returned jewellery will be valued at 100% of its purchase price if the purchase price of the new jewellery is more than 130% of the purchase price of the returned jewellery; or   
    (iv)     after 1 year immediately following the date of the sales invoice, client may exchange the returned jewellery for new jewellery on the following basis:   
        a.     the returned item should be first re-appraised by King Fook, King Fook may re-appraise the item by itself in accordance with such practice as it may think fit and such appraisal shall bind the client;   
        b.     the returned jewellery may be exchanged at the re-appraised value if the purchase price of the new jewellery is more than 130% of the purchase price or the re-appraised value (whichever is higher) of the returned jewellery, provided that the client shall pay the shortfall;   
        c.     no return will be allowed if the purchase price of the new jewellery is less than or equal to 130% of the purchase price or the re-appraised value (whichever is higher) of the returned jewellery.   
 7.     All refunds or exchanges permitted under the provisions of these Terms and Conditions shall be made subject to the condition that such product shall be in good, clean, intact, original condition accompanied by the relevant original sales invoice and certificate. King Fook reserves the absolute right to refuse any refund or exchange in the event such product, sales invoice or certificate has been damaged, defaced or altered.   
 8.     All chuk kam (足金) bars, gold jewellery, gold nuggets, gold coins, clock and watches, mobile phones, lighters, writing instruments and gifts etc. are not refundable nor exchangeable and the Client is deemed to have inspected such products and fully accepts their condition as they are upon purchase.   
 
 Maintenance and repair   
 
 9.     In the event that client’s article requires maintenance and/or repair (as the case may be) (“Repair”), please deliver it to one of King Fook’s shops in Hong Kong together with its sales invoice and all relevant warranty documents (the “Repair Documents”). Bearer of client’s article and the Repair Documents (the “Client”) will be deemed to have proper authority to arrange for Repair of the article for and on behalf of the Client. On receipt of Client’s article, King Fook would describe the article and the damage areas, if any, on the repair receipt (and would subsequently arrange for detailed inspection to confirm the genuineness of the product). The repair receipt will be issued to, and confirmed and signed by the Client.   
 10.     If King Fook does not receive any request to the contrary, King Fook may at its absolute discretion consider whether to attempt to conduct the Repair itself or send it to the manufacturer of the article or a service centre designated by such manufacturer (collectively the “Manufacturer”) for Repair. After completion of the Repair, King Fook will inform the Client to collect the article at its shop.   
 11.     Upon request or if King Fook considers that it is not appropriate to conduct the Repair itself, King Fook will on Client’s behalf arrange for the Manufacturer to attempt to conduct the Repair. In such event, without affecting the applicability of other provisions in these Terms and Conditions, the following sub-clauses will apply:   
    (i)     King Fook will not be responsible for any Repair of Client’s article but will send the article to the Manufacturer;    
    (ii)     If the Manufacturer agrees to conduct the Repair of the article, it will inform King Fook of its estimated costs, lead time and other terms and conditions relating to the Repair. King Fook will then pass this information and any other terms and conditions that may be imposed (collectively the “Additional Terms”) to the Client for Client’s confirmation. Client should reply to King Fook as to his acceptance or rejection of the Additional Terms within 7 days after being notified;   
    (iii)     If Client accepts the Additional Terms, King Fook will give instructions on Client’s behalf to the Manufacturer to conduct the Repair. If the Manufacturer is able to complete the Repair, King Fook will arrange for the return of the article. The article shall be collected at King Fook’s shop after notification;   
    (iv)     If the Manufacturer refuses or is unable to conduct the Repair or if Client does not agree to conduct the Repair or does not accept the Additional Terms within 7 days after notification, King Fook will inform the Client to collect the article from its shop. In such event, administration fees may be charged by the Manufacturer or King Fook, and any such fees shall be paid in full upon collection.   
 12.     On collection of the article, the Client shall present the original of the repair receipt. Bearer of the repair receipt shall be deemed to be duly authorised to collect the article. In the event that the original of the repair receipt cannot be produced, upon production of proper evidence proving Client‘s identity, King Fook may at its sole discretion release the article, provided that a declaration of lost repair receipt and deed of indemnity shall be signed by the Client upon collection of the article, in order to protect the parties’ interests.   
 13.     If Client’s article is not collected within 3 months after notification for collection, it will be considered abandoned and the Client hereby authorises King Fook to resell or dispose of such article in any way without any compensation to the Client. Any proceeds received from the resale or disposal of such item will be applied to pay for any costs of Repair and other expenses of or incurred by King Fook including but not limited to storage and administration fees. If the proceeds are not sufficient to cover the said costs and expenses, King Fook may claim against the Client for the shortfall.  Any balance of the proceeds remaining will be kept by King Fook for its sole and absolute benefit.   
 14.     The costs and time indicated by the Manufacturer or King Fook for Repair are estimates only. During the course of Repair, if it is revealed that extra costs and/or time are required, King Fook shall have the right to amend the terms relating to these with or without prior notice.   
 15.     All payments in relation to Repair must always be fully settled upon collection of the article. Until all such payments have been made, King Fook shall have a lien over the article.   
 16.     Notwithstanding any description of the article on the repair receipt, if the Manufacturer or King Fook finds that the article is counterfeit or any part of the article has been altered, added to or repaired by any party unauthorised by the Manufacturer, then the Manufacturer and/or King Fook may at any time refuse to conduct Repair without any further liabilities. In such event, the Manufacturer and/or King Fook may charge administration fees and such fees must be fully settled upon collection of Client’s article.   
 17.     In any event, all components, parts or other units that are replaced or removed in connection with Repair will not be returned, and King Fook is entitled to deal with or dispose of such components, parts or units in any manner as it absolutely thinks fit. Therefore, the Client is recommended to consider carefully before sending any sentimental or engraved item to King Fook for Repair.   
 
 
 Limitation of liability   
 
 18.     In the event that King Fook provides service for Repair or mounting service for jewellery, the following limitation of liability policy will apply:   
    (i)     King Fook shall not be liable whether in contract, tort or otherwise for loss of or damage to any item or article as a result of fire, flood, burglary, accident or unsatisfactory workmanship, omission, negligence or other act on the part of King Fook;   
    (ii)     King Fook shall not be responsible for any damage caused to or loss of Client’s article while it is out of its custody, including but not limited to while the article is in transit to the Manufacturer or under the repair or possession of the Manufacturer;  
    (iii) No sentimental value of Client’s article may be claimed against King Fook;  
    (iv)     If the above sub-clauses do not apply, King Fook’s entire liability for the damages from any cause whatsoever with respect to the Repair of the article, whether due to King Fook’s negligence or to any other reason, will be limited to the lower of the value of the article appraised by King Fook and the estimated costs of the service in question. 
    
General 
 
 19.     Please keep the original of this sales invoice/repair receipt (“this receipt”). The Client may be required to present this for various services at King Fook’s shops in Hong Kong.  This receipt is not intended to be used in King Fook’s shop(s) out of Hong Kong.   
 20.     If any provision of these Terms and Conditions is held to be illegal or unenforceable, that provision will no longer be part of these Terms and Conditions, and these Terms and Conditions will be enforceable as though, to the extent required, that provision had been deleted and never was a part of them.    
 21.     Save and except as provided under the relevant legislation under the Laws of Hong Kong, These Terms and Conditions are the only terms and conditions that govern King Fook’s sale and after-sale services, and no other express or implied (no matter oral or written) terms or conditions exist. King Fook has not authorised any person to vary any of these Terms and Conditions. In case of inconsistency with any warranties in respect of Client’s article, these Terms and Conditions shall prevail.   
 22.     These Terms and Conditions are subject to change by King Fook at any time and at its sole discretion with or without prior notice.   
 23.     The Chinese version of these Terms and Conditions is the translation of the English version and in the event of any contradiction or inconsistency between the Chinese version and this English version, this English version shall prevail.   
 24.     These Terms and Conditions are governed by the laws of Hong Kong and any dispute arising out of or in connection with these Terms and Conditions will be submitted to the courts of Hong Kong.
